This page explains what personal information I collect when you use this website or commission a portrait, why I need it, how long I keep it and what your rights are.
Who I am
Jane Darbyshire Portraits is run by me, Jane Darbyshire, a self-employed portrait artist based in London SW11. I am the “controller” of your personal information under UK data protection law (the UK GDPR and the Data Protection Act 2018).
Contact: drawings@janedarbyshire.com or 07939 493653.
What I collect and why
- Enquiries. If you use the contact form or email me, I receive your name, email address, subject and message. I use these to reply to you. Lawful basis: steps taken at your request before entering into a contract, and my legitimate interest in answering enquiries.
- Commissions. If you order a portrait, I keep your name, contact details, postal address, the photographs you send me and notes about the portrait. I use these to draw the portrait, send you proofs, take payment and post the finished drawing. Lawful basis: performing our contract.
- Payments. Deposits and balances are paid by bank transfer or PayPal. I see the payer’s name and payment reference; I never see or store card details. I keep payment records because tax law requires it. Lawful basis: legal obligation.
- Website analytics. If you accept analytics cookies, Google Analytics records how visitors use the site, such as pages viewed, approximate location (city level), device and browser, and the site that referred you. I use this only to understand which pages are useful. Lawful basis: your consent, which you can withdraw at any time.
Photographs of children and pets
Photographs you send me are used only to create your portrait. I do not share them with anyone else.
I sometimes show finished portraits in my gallery and on social media. I will only do so with your permission, and I will remove a portrait if you ask.
Who I share information with
I do not sell your information or use it for advertising. It is only handled by the services I rely on to run the business:
- Hostinger, who host this website and its contact form
- my email provider, which stores enquiries and correspondence
- PayPal or my bank, if you pay that way
- Royal Mail, who receive your name and address to deliver your portrait
- Google, who provide Google Analytics (only if you accept analytics cookies)
Some of these providers, including Google and PayPal, may process data outside the UK. When they do, they use legal safeguards such as the UK International Data Transfer Addendum or the UK–US Data Bridge.
How long I keep it
- Enquiries that do not lead to a commission: up to 12 months
- Commission and payment records: 6 years after the end of the tax year, as HMRC requires
- Photographs you send for a commission: deleted 12 months after the portrait is delivered, unless you ask me to keep them for a future order
- Google Analytics data: 14 months
Cookies
This site only sets analytics cookies if you click “Accept” on the cookie banner. If you click “Reject”, or do nothing, Google Analytics is not loaded. Your choice is saved in your browser so the banner does not appear on every page.
- _ga and _ga_7J7756STXJ (Google Analytics): distinguish visitors and sessions. Expire after 2 years.
- jd_cookie_consent (browser storage, not a cookie): remembers whether you accepted or rejected analytics. Kept until you clear your browser data.
Your rights
You have the right to:
- ask for a copy of the personal information I hold about you
- ask me to correct it if it is wrong
- ask me to delete it, unless I have to keep it by law
- object to, or ask me to restrict, how I use it
- withdraw your consent to analytics cookies at any time
To use any of these rights, email drawings@janedarbyshire.com. I will reply within one month.
Complaints
If you are unhappy with how I have handled your information, please contact me first. You can also complain to the Information Commissioner’s Office (ICO) at ico.org.uk/make-a-complaint or on 0303 123 1113.
